GENERAL TERMS OF SALE

1. Purpose and identification of the seller

These General Terms of Sale (the "GTS") govern the purchase of products offered on the website https://bodegaseliasmora.com/ (the "Website"), owned by BODEGAS ELIAS MORA SLU, tax ID (CIF) B47464045, registered office at C/Juan Mora, s/n, 47530 San Román de la Hornija (Valladolid, Spain), registered with the Commercial Registry of Valladolid, Volume 927, Folio 193, Sheet VA-12076 (the "Seller").

Anyone placing an order through the Website (the "User" or "Customer") expressly accepts these GTS, which shall prevail over any other conflicting general or specific terms.

2. Legal drinking age requirement

The products sold on the Website are alcoholic beverages. Purchases are reserved exclusively for persons over 18 years of age. By confirming an order, the User declares and warrants being of legal age under Spanish law and the law of the destination country. The Seller reserves the right to request proof of age upon delivery and to cancel any order where reasonable doubt exists as to compliance with this requirement.

3. Products, prices and taxes

The products offered are those listed on the Website at the time the order is placed, with their corresponding description and images, which are for illustrative purposes only. Prices shown include Value Added Tax (VAT) in force at the time, unless expressly stated otherwise, and do not include shipping costs, which are shown separately before order confirmation.

The Seller reserves the right to modify prices at any time; however, products will be invoiced at the price in effect when the order was placed.

4. Territorial scope of sale

The Seller ships to Spain and to the following European Union countries: Portugal, France, Germany, Austria, Italy, Belgium, Slovakia, Slovenia, Greece, Luxembourg, the Netherlands, Poland, and the Czech Republic. For destinations not included in this list, the User may check availability and special terms by writing to administracion@bodegaseliasmora.com.

5. Purchase process

The purchase process consists of the following steps: product selection, cart review, entry of shipping and billing details, selection of payment method, and order confirmation. Before confirming the order, the User may review and amend the information entered. Once the order is confirmed, the User will receive a confirmation email summarising the purchase.

6. Payment methods

Payment may be made by credit/debit card via the secure Redsys/CaixaBank gateway, or via PayPal. All transactions are processed using secure encryption protocols; the Seller does not store full payment card details.

7. Shipping costs and delivery times

Shipping costs are calculated according to the delivery destination:

  • Mainland Spain and Portugal: €12 (VAT included). Free shipping on orders over €85.

  • Other EU countries served by the Seller: €85 (VAT included).

  • For destinations not listed, please check availability and cost at administracion@bodegaseliasmora.com.

Unless expressly stated otherwise, any promotions or discounts on shipping costs apply only to shipments within mainland Spain.

Estimated delivery times are:

  • Spain: 2 to 5 business days from order confirmation.

  • Rest of the European Union: 4 to 7 business days from order confirmation.

These timeframes are indicative and may vary due to circumstances beyond the Seller's control (carrier delays, customs, force majeure). In any case, delivery will always take place within thirty (30) calendar days from order confirmation, in accordance with Spanish consumer protection law (RDL 1/2007, Art. 66 bis).

Delivery will be made to the address freely designated by the User in the order form.

8. Transport and condition of goods

Shipments include insurance against breakage or damage in transit. If an order arrives in poor condition, the User must:

  1. Report it in writing on the carrier's delivery note upon receipt.

  2. Notify the Seller within a maximum of 24 hours via administracion@bodegaseliasmora.com.

  3. Provide photographs showing the condition of the outer packaging before opening it, and the condition of the product after opening.

Failure to follow this procedure may hinder or prevent the processing of a claim against the carrier.

9. Right of withdrawal

In accordance with Articles 102 et seq. of the Spanish General Law for the Protection of Consumers and Users, Users qualifying as consumers have 14 calendar days from receipt of the order to exercise their right of withdrawal, without needing to provide a reason.

To exercise this right, the User must inform the Seller unambiguously via email to administracion@bodegaseliasmora.com or by written notice sent to the Seller's registered office, within the stated period.

Conditions for withdrawal: the product must be returned unopened, unconsumed, and in perfect condition, in its original packaging, together with all accessories. The Seller reserves the right to reduce the refund amount if the product shows signs of having been handled, opened, or damaged for reasons not attributable to transport.

Return shipping costs are borne by the User. Once the returned product has been received and verified to be in perfect condition, the Seller will refund the full price of the product (excluding original shipping costs) within a maximum of 14 days from receipt of the return, using the same payment method used by the User, unless the User expressly requests otherwise.

Exceptions: in accordance with Article 103 of the above-mentioned law, the right of withdrawal cannot be exercised where the product has been opened, consumed, or handled in a way that prevents its subsequent resale under health-safety guarantees, nor in the case of alcoholic beverages whose price depends on financial market fluctuations beyond the Seller's control and which cannot be delivered within 30 days of the order.

10. Legal guarantees

Products carry the legal guarantees established under the Spanish General Law for the Protection of Consumers and Users for cases of non-conformity with the contract. Users may exercise these rights by contacting the Seller at administracion@bodegaseliasmora.com.

11. Ingredients and nutritional information

In accordance with Regulation (EU) 2021/2117, wines sold on the Website carry a QR code on their physical label giving access to the ingredient list and nutritional information. This same information is also available on each product page on the Website prior to completing the purchase.

12. Online dispute resolution

In accordance with Regulation (EU) No. 524/2013, EU-resident Users are informed that the European Commission provides an Online Dispute Resolution (ODR) platform, accessible at: https://ec.europa.eu/consumers/odr.

13. Governing law

These GTS are governed by Spanish law. For consumers residing in another EU Member State, the mandatory consumer protection provisions of their country of residence shall also apply where more favourable.
